P37 Founder OS (available at os.p37.partners) is operated by P37 Partners. This Privacy Statement explains how we collect, use, store, and protect your information when you use our platform.

Third-Party Integrations
When you connect QuickBooks, HubSpot, Stripe, or LinkedIn, data is fetched via their official APIs under your authorization. P37 Partners acts as a data processor; you remain the data controller. Each integration can be disconnected at any time from your Settings page.
Data Sharing
We do not sell, rent, or trade your personal information. We may share data with service providers (Supabase, n8n) under confidentiality agreements. We may disclose information if required by law.
Data Retention
Account data is retained while your account is active. Upon account termination, personal data is deleted within 30 days.

This End-User License Agreement ("Agreement" or "EULA") is a legally binding agreement between you—the individual or legal entity accessing or using the Founder OS platform ("User," "you," or "your")—and P37 ("P37," "we," "us," or "our"), the developer and operator of Founder OS.
Founder OS is an AI-powered operating system for founder-led companies that connects to third-party business tools, aggregates key performance indicators, detects anomalies in business metrics, generates AI-powered insights and briefings, and delivers automated alerts—all on a subscription basis.
This Agreement governs your access to and use of Founder OS, including the web platform at os.p37.partners, all associated APIs, integrations, automated workflows, AI-generated content, and any related services provided by P37 (collectively, the "Platform"). This Agreement should be read in conjunction with P37's Privacy Statement, which is incorporated herein by reference.
2. Acceptance of Terms
By accessing, registering for, or using Founder OS in any way, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.
IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU MUST NOT ACCESS OR USE FOUNDER OS.
Your continued use of the Platform following any modifications to this Agreement constitutes your acceptance of those modifications.
3. License Grant
Subject to your compliance with this Agreement and payment of applicable subscription fees, P37 grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use Founder OS solely for your internal business purposes during the term of your subscription.
This license does not include the right to: (a) resell or commercially exploit the Platform or its outputs; (b) use the Platform on behalf of third parties without P37's express written consent; or (c) use the Platform for purposes other than those described in this Agreement and the applicable subscription documentation.
4. License Restrictions
You agree not to, and shall not permit any third party to:
(a) copy, modify, adapt, translate, reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the Platform or any component thereof;
(b) create derivative works based on the Platform without P37's express written consent;
(c) resell, sublicense, rent, lease, or otherwise transfer your rights to the Platform to any third party;
(d) use the Platform to build a competing product or service, or to gather competitive intelligence about P37;
(e) use automated tools, bots, scrapers, or scripts to access, extract, or index content from the Platform, except as expressly permitted by P37;
(f) attempt to gain unauthorized access to any part of the Platform, other user accounts, or P37's infrastructure;
(g) use the Platform in any way that violates applicable law, regulation, or third-party rights; or
(h) remove, alter, or obscure any proprietary notices, labels, or marks on the Platform.
5. Third-Party Integrations
5.1 Authorization
By connecting third-party accounts to Founder OS (including but not limited to Stripe, HubSpot, QuickBooks, OpenAI, and Anthropic), you expressly authorize P37 to access and retrieve data from those accounts on your behalf for the purpose of providing the Platform's services.
5.2 Your Responsibility
You are solely responsible for: (a) maintaining valid credentials for all connected third-party accounts; (b) complying with the terms of service, developer agreements, and acceptable use policies of each third-party platform; and (c) ensuring that you have all rights and permissions necessary to share third-party data with Founder OS.
5.3 Third-Party Terms
Your use of connected integrations is subject to the respective terms of each third-party platform, including but not limited to Stripe's API Terms of Service and Intuit's (QuickBooks) Developer Agreement. P37 is not a party to those agreements and assumes no responsibility for third-party compliance requirements.
5.4 No Liability for Third Parties
P37 is not responsible for: (a) the accuracy, completeness, or availability of data retrieved from third-party platforms; (b) changes to third-party APIs that may affect Platform functionality; or (c) any downtime, service interruptions, or errors originating from third-party systems.
5.5 Data Rights
You represent and warrant that you have the legal right to share all data you provide or authorize P37 to retrieve, including data belonging to your customers, employees, or business partners.
6. AI-Generated Content and Insights
6.1 AI Providers
Founder OS uses third-party artificial intelligence services, including models provided by OpenAI and Anthropic, to generate insights, anomaly alerts, briefings, and other analytical outputs.
6.2 Informational Purpose Only
All AI-generated content produced by Founder OS—including but not limited to trend analyses, anomaly alerts, performance briefings, and business insights—is provided for informational purposes only. Such content does not constitute financial, legal, accounting, investment, or professional business advice.
6.3 No Guarantee of Accuracy
P37 does not warrant the accuracy, completeness, timeliness, or fitness for a particular purpose of any AI-generated output. AI models may produce incomplete, inaccurate, or contextually inappropriate results.
6.4 Independent Verification
You acknowledge that you should independently verify any AI-generated insight before making business decisions based on such output. P37 shall not be liable for any decision made, or action taken or not taken, in reliance on AI-generated content from the Platform.
6.5 AI Provider Terms
Your use of AI-powered features is also subject to the terms of the applicable AI providers. P37 does not control the outputs, availability, or policies of third-party AI models.
7. Data and Privacy
7.1 Privacy Statement
P37's collection, use, and handling of personal and business data is governed by the P37 Founder OS Privacy Statement, available at os.p37.partners/privacy, which is incorporated into this Agreement by reference. In the event of any conflict between this Agreement and the Privacy Statement regarding data handling, the Privacy Statement shall control.
7.2 Summary of Data Practices
By way of summary—and not in limitation of the full Privacy Statement—P37's core data practices include the following:
(a) Integration credentials (API keys, OAuth tokens) are stored in encrypted form and are never transmitted in plain text;
(b) KPI data retrieved from your connected integrations is used exclusively to provide the Platform's services to you and is not sold, licensed, or shared with third parties for commercial purposes;
(c) AI-generated outputs are produced using your data inputs but are not retained by third-party AI providers for training purposes, subject to each provider's applicable terms; and
(d) P37 implements industry-standard security measures to protect your data.
7.3 Data Ownership
You retain all ownership rights to your business data. P37's access to your data is limited to what is necessary to provide the Platform's services.
8. Intellectual Property
8.1 P37's Intellectual Property
Founder OS and all of its components, including but not limited to its software code, platform architecture, user interface design, algorithms, data models, AI prompts, analytical frameworks, documentation, and branding, are and remain the exclusive intellectual property of P37 and its licensors. Nothing in this Agreement transfers any ownership interest in P37's intellectual property to you.
8.2 User Data and Content
All data you provide to or generate through Founder OS, including data from your connected third-party accounts, business metrics, configuration settings, and any annotations or notes you create within the platform, remains your property. You grant P37 a limited, non-exclusive license to access, process, and use your data solely as necessary to provide the Platform's services during the term of your subscription.
8.3 Feedback
If you provide P37 with feedback, suggestions, or ideas regarding the Platform ("Feedback"), you grant P37 a perpetual, irrevocable, worldwide, royalty-free license to use, incorporate, and commercialize such Feedback without restriction or compensation to you.
9. Subscription and Payment
9.1 Subscription Model
Access to Founder OS is provided on a subscription basis. Subscription fees, billing cycles, and payment terms are set forth in the order form, pricing page, or subscription agreement accepted by you at the time of registration.
9.2 Payment Obligation
You agree to pay all applicable subscription fees in accordance with your selected plan. Fees are non-refundable except as expressly provided in this Agreement or required by applicable law.
9.3 Suspension for Non-Payment
P37 reserves the right to suspend or restrict your access to the Platform if any payment becomes overdue by more than fifteen (15) days, provided that P37 gives you reasonable advance written notice before such suspension.
9.4 Price Changes
P37 may modify subscription pricing with at least thirty (30) days' written notice. Your continued use of the Platform after the price change takes effect constitutes your acceptance of the new pricing.
10. Confidentiality
10.1 Definition
"Confidential Information" means any non-public information disclosed by one party to the other that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure.
10.2 Obligations
Each party agrees to: (a) hold the other party's Confidential Information in strict confidence using at least the same degree of care it uses to protect its own confidential information (but no less than reasonable care); (b) not disclose Confidential Information to any third party without the disclosing party's prior written consent; and (c) use the other party's Confidential Information solely for the purposes of this Agreement.
10.3 P37's Confidential Information
P37's Confidential Information includes, without limitation, the Platform's source code, algorithms, pricing structures, technical architecture, and business methods.
10.4 Your Confidential Information
Your Confidential Information includes your business data, financial metrics, integration credentials, and any proprietary business information processed through the Platform.
10.5 Exclusions
Confidentiality obligations do not apply to information that: (a) is or becomes publicly available through no fault of the receiving party; (b) was rightfully known to the receiving party before disclosure; (c) is independently developed by the receiving party without use of Confidential Information; or (d) is required to be disclosed by law or court order, provided the receiving party gives prompt written notice to the disclosing party.
11. Termination
11.1 Termination by You
You may terminate your subscription at any time by following the cancellation procedures available within the Platform or by contacting P37. Termination will take effect at the end of the then-current billing period.
11.2 Termination by P37 for Cause
P37 may terminate this Agreement upon written notice if you materially breach any provision of this Agreement and fail to cure such breach within thirty (30) days after receiving written notice specifying the breach. Notwithstanding the foregoing, P37 may terminate this Agreement immediately and without a cure period if: (a) you engage in a material security breach or attempt to compromise the Platform's integrity; (b) you violate Section 4 (License Restrictions); or (c) your actions expose P37 to legal liability or reputational harm.
11.3 Effect of Termination
Upon termination: (a) your license to use the Platform immediately ceases; (b) P37 will handle your data in accordance with the Privacy Statement; and (c) any fees paid prior to termination are non-refundable except as required by law. Sections 8, 10, 12, 13, 14, and 15 shall survive termination.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, P37 EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
(a) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
(b) ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
(c) ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY DATA, AI-GENERATED CONTENT, OR INFORMATION PROVIDED THROUGH THE PLATFORM; AND
(d) ANY WARRANTY THAT THE PLATFORM WILL MEET YOUR SPECIFIC BUSINESS REQUIREMENTS.
YOU ACKNOWLEDGE THAT YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
13. Limitation of Liability
13.1 Exclusion of Consequential Damages
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL P37, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE PLATFORM, EVEN IF P37 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13.2 Aggregate Cap
P37's total aggregate liability to you arising out of or related to this Agreement, regardless of the theory of liability, shall not exceed the total subscription fees paid by you to P37 in the twelve (12) months immediately preceding the event giving rise to the claim.
13.3 Essential Basis
The parties acknowledge that the limitations of liability in this Section reflect a reasonable allocation of risk and form an essential basis of the bargain between the parties. P37 would not enter into this Agreement without these limitations.
14. Indemnification
14.1 Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless P37, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
Misuse of the Platform: Your use of Founder OS in violation of this Agreement, applicable law, or the rights of any third party;
Third-Party Terms Violations: Your violation of the terms of service or developer agreements of any third-party platform (including Stripe, HubSpot, QuickBooks, or any other connected integration) that occurs in connection with your use of Founder OS;
Data Rights Misrepresentation: Any claim that you did not have the right or authority to share data with Founder OS from your connected third-party accounts, including data belonging to your customers, employees, or business partners; or
Your Content or Data: Any claim arising from the content of your data that P37 processes on your behalf in connection with the platform.
14.2 P37's Indemnification Obligations
P37 agrees to indemnify, defend, and hold harmless you from and against any third-party claims alleging that the Platform itself (excluding your data and third-party integrations) infringes any valid U.S. patent, copyright, or trademark, provided that you: (a) promptly notify P37 in writing of such claim; (b) grant P37 sole control over the defense and settlement of the claim; and (c) provide reasonable cooperation to P37 in defending the claim.
15. Governing Law and Dispute Resolution
15.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
15.2 Jurisdiction
Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina. Each party irrevocably submits to the personal jurisdiction of such courts.
15.3 Waiver of Jury Trial
TO THE EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS AGREEMENT.
16. Changes to This Agreement
P37 reserves the right to modify this Agreement at any time. When changes are made, P37 will provide at least thirty (30) days' written notice via email to the address associated with your account or through a prominent notice within the Platform. Your continued use of the Platform after the effective date of the revised Agreement constitutes your acceptance of the changes. If you do not agree to the revised terms, you must discontinue use of the Platform before the effective date of the changes.

18. General Provisions
18.1 Entire Agreement
This Agreement, together with the Privacy Statement and any applicable order form or subscription agreement, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, representations, and understandings.
18.2 Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
18.3 Waiver
No failure or delay by either party in exercising any right under this Agreement shall constitute a waiver of that right. Waivers must be in writing to be effective.
18.4 Assignment
You may not assign this Agreement or any rights or obligations hereunder without P37's prior written consent. P37 may assign this Agreement without restriction in connection with a merger, acquisition, or sale of all or substantially all of its assets.
18.5 Notices
All notices under this Agreement shall be in writing and delivered to the addresses specified in the applicable order form or, in the absence of such specification, to the contact information available at os.p37.partners.
18.6 Force Majeure
Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, natural disasters, government actions, or internet infrastructure failures.
